Privacy policy
The short version
- Your heart and health data stays on your phone. We never see it.
- We never sell or share your personal information, and we never use it for advertising.
- We don’t show ads, in the app or anywhere else.
- Whirly doesn’t need an account. The only personal information we hold is what you choose to send us, like your email for the waitlist.
- You can ask us to delete anything we hold about you, any time, at hello@nicewhirly.com.
Who we are
Whirly is made by Whirly LLC, a company registered in New York, USA. In this policy, “Whirly,” “we” and “us” mean Whirly LLC.
This policy covers our website, nicewhirly.com, and the Whirly app for iPhone and Android, including test (beta) versions. Whirly is a wellness app for guided breathing. It is not a medical device and doesn’t diagnose or treat any condition.
What we collect
We collect as little as we can. Most of what the app knows about you never leaves your phone.
On our website. Our hosting provider automatically handles basic technical information, such as your IP address and browser type, to deliver the site and protect it from attacks. We don’t use advertising or tracking cookies.
When you join the waitlist. You give us your email address. You may also tell us which phone you use and which watch you wear, so we can invite the right testers. The waitlist form is run by our form provider (see “Who we share it with”).
In the app, stored only on your phone:
- The goal you pick (such as “Ease stress”), your reminder times and your settings
- Your breathing sessions: when you did them, which pattern and for how long
- Heart data the app reads from Apple Health or Health Connect, and the personal baselines it calculates from that data
- Your answers to “Were you stressed?” check-ins
We don’t have access to any of this. It stays in the app on your device, and it’s deleted if you delete the app.
Anonymous usage information. The app may send anonymous usage events to us, such as “a session was completed” or “onboarding was finished,” so we can see what’s working and fix problems. These events never include your name, email, or any heart or health data, and they aren’t linked to your identity.
Beta testing. If you test Whirly through Apple TestFlight or Google Play testing, Apple or Google may share with us your tester email, device model, crash reports and any feedback you choose to send. Their own privacy policies cover how they handle this.
When you contact us. If you email us, we receive your email address and whatever you write.
Heart and health data
Whirly reads your heart data only with your permission, uses it only on your phone, and never sends it to us or anyone else.
- What we read. With your permission, Whirly reads heart rate, resting heart rate and heart rate variability from Apple Health (iPhone) or Health Connect (Android). Your watch or other apps put this data there.
- What we write. With your permission, Whirly saves each completed session to Apple Health or Health Connect as mindfulness time.
- Why. To learn your normal levels, show your trends, and suggest a breathing session when your readings suggest you may be stressed.
- Where it stays. All of this happens on your phone. Your health data isn’t sent to our servers (we don’t have any for it), isn’t included in our usage information, and isn’t shared with anyone.
- What we never do. We never sell health data, never use it for advertising or marketing, and never use it to make decisions about you such as eligibility for insurance, credit or employment.
- You’re in control. You can turn off Whirly’s access at any time in the Health app (iPhone) or Health Connect settings (Android). The rest of the app keeps working without it.
How we use information
We use the little information we hold only to run and improve Whirly:
- To invite you to the beta and tell you when Whirly is available
- To answer your questions and support requests
- To understand, in anonymous and combined form, which features people use, and to fix bugs and crashes
- To keep our website and app secure
- To meet legal obligations
We’ll only email you about Whirly. Every email includes a way to stop receiving them.
Who we share it with
We don’t sell or rent personal information. We share it only with the service providers below, who help us run Whirly and may use it only to provide their service to us. None of them receive your heart or health data.

We may also disclose information if the law requires it, to protect someone’s safety, or as part of a sale or merger of our business. If that ever happens, this policy’s promises about health data will still apply.
Cookies, retention and security
Cookies. Our website doesn’t use advertising or tracking cookies. Our providers may use small, essential cookies to keep the site and the waitlist form working and secure.
How long we keep things.
- Waitlist details: until Whirly launches publicly, or until you ask us to remove them
- Emails you send us: as long as needed to help you, then deleted within 12 months
- Anonymous usage information: up to 24 months, then deleted or combined into totals
- Data inside the app: on your phone until you delete it or the app
Security. We use reputable providers, encrypted connections (HTTPS) and the security built into your phone. No system is perfectly secure, but keeping your health data on your device means it isn’t stored anywhere we could lose it.
Your choices and rights
You can ask us, at any time, to show you the personal information we hold about you, correct it, or delete it. Email hello@nicewhirly.com and we’ll respond within 30 days. We won’t treat you differently for asking.
Depending on where you live, including California and the European Union, you may have additional legal rights, such as the right to know what we collect and to object to certain uses. We honor these rights for everyone, wherever they live.
You can also:
- Leave the waitlist or unsubscribe from our emails at any time
- Turn off Whirly’s health data access, notifications or reminders in your phone’s settings
- Delete all Whirly data on your phone by deleting the app
Children
Whirly is not intended for children under 13, and we don’t knowingly collect information from them. If you believe a child has given us information, contact us and we’ll delete it.
International users
Whirly is based in the United States. If you contact us or join the waitlist from another country, your information will be handled in the United States and by our providers, who may operate in other countries.
Changes to this policy
If we change this policy, we’ll update the date at the top. If a change affects how we handle your information in a meaningful way, we’ll tell you in the app or by email before it takes effect.
